1. Acceptance of Terms

By downloading, installing, or using Toy Rotation App, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the app.

2. Eligibility

Toy Rotation App is designed for parents and caregivers and is not directed to children. If you purchase an Early Adopter offer or otherwise enter into a purchase transaction with us, you must be at least the age of majority in your jurisdiction and able to agree to these Terms.

3. Description of Service

Toy Rotation App is a mobile application designed to help parents organize and rotate their toys. We may also operate related web pages for product information, waitlist signups, and optional early-adopter purchases. The app provides the following features:

Toy scanning: You photograph your toys, and AI identifies them from the photos.
Toy rotation: The app generates balanced toy rotation schedules based on toy categories.
Play stories: The app suggests play story ideas to accompany toy rotations.

4. AI-Generated Content

Toy Rotation App uses AI (Google Gemini) to power its core features, including toy identification, categorization, rotation suggestions, and play story ideas. You should be aware of the following:

AI can make mistakes. Toy names, categories, and suggestions are generated by AI and may be inaccurate, incomplete, or inappropriate. Always review and edit AI-generated content before relying on it.
Not professional advice. Rotation suggestions and play stories are not a substitute for professional child development, educational, or medical advice. They are meant as helpful starting points, not expert recommendations.
Parent review is essential. You are responsible for reviewing all AI-generated content and deciding what is appropriate for your child.

5. User Responsibilities

When using Toy Rotation App, you agree to:

Use the app in a lawful and appropriate manner.
Provide accurate information when adding or editing toy details.
Supervise children during play, regardless of any suggestions the app provides.
Review toy rotation suggestions and play stories for age-appropriateness and safety before acting on them.
When using the toy scanning feature, photograph toys only. Avoid including children's faces or other people in toy photos.
Not use the app to upload or process illegal, harmful, or inappropriate content.

You are solely responsible for any decisions you make based on the app's output, including toy selection and play activities for your children.

6. Intellectual Property

Our content. The design, code, branding, and original content of Toy Rotation App are owned by Toy Rotation App and protected by applicable intellectual property laws. You may not copy, modify, distribute, reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code of, or create derivative works from, any part of the app.
Your content. You retain full ownership of the photos you take and any personal data you enter into the app. By using the app, you grant Toy Rotation App a non-exclusive, revocable license to process your photos through AI services solely for the purpose of providing the app's features. This license does not include use of your photos to train or improve AI models. This license terminates when the relevant processing is complete and you delete the relevant content or stop using the app, subject to any limited retention described in our Privacy Policy.

7. Early Adopter / Preorder Terms

We may offer optional Early Adopter or preorder purchases through our website before the App is generally released. If you make one of these purchases:

Merchant of record. Checkout may be processed by Paddle, which acts as the merchant of record for the transaction. Paddle may process your payment, collect applicable taxes, issue receipts, and handle certain billing-related requests. Paddle's buyer terms, checkout terms, and privacy practices may also apply to the transaction.
What "lifetime access" means. "Lifetime access" means access for the commercial lifetime of the Toy Rotation App product or service that corresponds to the Early Adopter offer you purchased. It applies only to the consumer offering explicitly included in that purchase. It does not guarantee access to every future feature, add-on, subscription, platform, region, or separately priced product we may offer later.
Features and launch timing may change. Because this is a preorder for a not-yet-released product, features, functionality, availability, platform support, pricing, packaging, and release timing may change before launch. Unless we expressly state otherwise at checkout, we do not guarantee a specific release date.
If launch is delayed or does not happen. If we materially delay launch after giving you a release estimate or decide not to launch the purchased offering at all, we may contact you with updated information and options. If we determine that we will not provide the purchased offering, we will cancel the preorder and issue a refund.
Refunds before release. You may request a refund before release by contacting support@toyrotation.app or using the contact information in your Paddle receipt. Approved refunds will be processed by Paddle to the original payment method where possible. After release, refund rights are governed by the checkout terms presented at purchase, Paddle's applicable terms, and any rights that cannot be waived under applicable law.

8. Subscriptions and Auto-Renewal

If you purchase a subscription to Toy Rotation App through the Apple App Store, Google Play, or another supported in-app platform, the following terms apply in addition to Section 7 (which covers optional Early Adopter / preorder purchases made through our website via Paddle):

Auto-renewal. Your subscription renews automatically at the end of each billing period (weekly, monthly, or yearly, as selected at purchase) at the then-current price, unless you turn off auto-renewal at least 24 hours before the end of the current period.
Billing. Payment is charged to your Apple ID, Google account, or other platform payment method at confirmation of purchase, and again within 24 hours before the start of each renewal period.
Free trials. If your subscription includes a free trial, any unused portion of the trial is forfeited when a paid subscription begins. Free trials are typically offered only to eligible new subscribers.
Managing or cancelling. You can view, change, or cancel your subscription at any time through the platform you purchased it on.
Cancellation effect. Cancelling turns off auto-renewal. You keep access for the remainder of the current paid period. We do not provide refunds for unused time in a paid period, except where required by applicable law or the platform's own refund policy.
Price changes. We may change subscription prices from time to time. Where required by applicable law or platform policy, we will notify you in advance of any price change affecting your subscription and give you an opportunity to cancel before the new price takes effect.

This Section 8 governs in-app platform subscriptions only. Purchases made through our website via Paddle remain governed by Section 7 and the checkout terms presented at the time of purchase.

9. Privacy

Your privacy matters to us. Please review our Privacy Policy for details on how your data is handled.

10. Disclaimer of Warranties

Toy Rotation App is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. We do not warrant that:

The app will be available at all times or free from errors.
AI-generated toy identifications, categories, or suggestions will be accurate, complete, or suitable for your needs.
The app will meet your specific requirements or expectations.

11. Limitation of Liability

To the fullest extent permitted by applicable law, Toy Rotation App and its creators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app. This includes, but is not limited to:

Decisions you make based on AI-generated suggestions, rotations, or play stories.
Any assessment of toy safety, age-appropriateness, or suitability. The app does not evaluate whether specific toys are safe for your child.
Loss of data stored on your device.
Any interruption or discontinuation of the service.

You acknowledge that toy safety is your responsibility as a parent or guardian, and that the app does not replace your own judgment or professional safety guidance.

Aggregate liability cap. To the fullest extent permitted by applicable law, the total aggregate liability of Toy Rotation App and its creators to you for any and all claims arising out of or relating to the app, these Terms, or your use of the service - whether in contract, tort (including negligence), warranty, or any other theory - will not exceed the greater of (a) fifty U.S. dollars (US$50) or (b) the total amount you paid us in the twelve (12) months immediately preceding the event giving rise to the claim. Nothing in this section limits liability that cannot be excluded or limited under applicable law.

12. Indemnification

You agree to indemnify, defend, and hold harmless Toy Rotation App and its creators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the app, your violation of these Terms, or content you upload through the app - including any photos containing images of people uploaded in violation of Section 5.

13. Termination

We reserve the right to modify, suspend, or discontinue Toy Rotation App (or any part of it) at any time, with or without notice. Since the app stores data locally on your device, discontinuation of the service does not delete your existing data.

14. Changes to Terms

We may update these Terms of Service from time to time. When we make changes:

The "Last Updated" date at the top of this page will be revised.
Continued use of the app after changes are posted constitutes your acceptance of the updated terms.
